Welcome to The Advancing Genealogist‘s New York case law page. Case law is law derived from a judicial decision, often made in an appellate court. Not every appellate decision is published.
A quick explanation. Digests are not case law itself. Instead, digests serve as indexes to cases that deal with specific legal topics, and often provide a very brief summary of what the court decided. Digests are arranged topically. To see cases that dealt with divorce, find the legal topic divorce to see a list of cases that addressed points of law regarding divorce. Digests allow the reader to see a list of opinions from different jurisdictions and different time periods covered by that digest in one place, and they suggest how court decisions impacted the evolution of a legal topic.
To find a record of a case, obtain the relevant case reporter volume. A reporter contains a meatier summary of the issue and the court’s decision. The information needed to find the correct reporter is in the digest. Sometimes a Google search of a case name brings results.
